Terms of Service

These terms govern your use of the Cullit website and app. By creating an account or using Cullit, you agree to them. Cullit is operated by Brice Virassamy, entrepreneur individuel.

The service

Cullit is a macOS application that helps photographers cull their photos with on-device AI assistance. It is currently in beta, so features may change and occasional issues are expected.

Your account

You need an account to subscribe. You are responsible for keeping your login secure and for activity under your account, and you must be old enough to enter a contract where you live. You must be of legal age (18 or over) to create an account and subscribe.

Requirements and devices

Cullit runs on macOS; a Windows build is in preparation. The current minimum versions are shown on the download page. One subscription covers your personal use on 1 device; you can add up to 2 extra devices as a paid option ($2.00 per month each, or $1.50 per month billed yearly, in USD — where checkout shows your local currency, the exact amount appears before payment). Your plan's device count is shown before payment and in your account on cullit.app, where you can change it at any time. Culling runs on-device; an internet connection is needed for your account, licence checks and updates.

Subscription and billing

Cullit is a single subscription plan, billed monthly or yearly at the price shown on our pricing page and at checkout. Orders are processed by our merchant of record, Paddle, who handles payment, applicable taxes and invoicing. Paid plans renew automatically until you cancel. A 14-day free trial is available when you take out a subscription: a valid payment method is required to start it, nothing is charged during the trial, and unless you cancel before it ends the subscription continues and the first payment is taken automatically. Trials started under an earlier version of these terms ran without a payment method and are unaffected.

Seller of record and contract documents

Purchases are processed by our merchant of record, Paddle: when you subscribe, the payment transaction is concluded with Paddle, whose Terms of Sale and refund policy apply to the transaction itself. These terms govern the Cullit service and your account. In case of conflict: the legal notice identifies the publisher, these terms govern the service, the Privacy Policy governs personal data, and Paddle's terms govern payment, taxes and invoicing.

Ordering and conclusion of the contract

To subscribe: create an account, choose a plan from your account area, and complete payment in the secure Paddle checkout. Before paying you can review your order, correct input errors and see the exact price, taxes and renewal terms; the payment button makes the obligation to pay explicit. The contract is concluded when Paddle confirms your order, and you receive a durable confirmation by e-mail.

Free trial and right of withdrawal

The trial is free, but it requires a valid payment method and becomes a paid subscription when it ends unless you cancel first; you can cancel at any time during the trial from your account. If you subscribe from the EU/EEA, you have a 14-day right of withdrawal. Because access is digital and immediate, at checkout you can ask us to start your subscription right away and acknowledge that this waives the withdrawal right once the service has been fully provided.

Withdrawal form (consumers)

To withdraw — as a consumer, within 14 days of subscribing, unless you asked for immediate provision and acknowledged losing the right once the service is fully performed — send us an unambiguous statement: by e-mail to support@cullit.app, or by letter to the address given in the legal notice. You may use this model: “I hereby give notice that I withdraw from my contract for the provision of the Cullit subscription — ordered on [date] — [name] — [e-mail used for the account] — [date and signature if on paper].” We will acknowledge receipt on a durable medium; any refund due is processed through Paddle under the withdrawal rules.

Cancelling

You can cancel anytime from your account on cullit.app. Your plan then runs to the end of the period you have already paid for and does not renew. Amounts already paid for a started period are not refunded, except where the law requires it (such as the EU withdrawal right above); refunds that are legally due are processed by our merchant of record, Paddle, back to your original payment method. Cancellation is available online, directly and without assistance, from your account's Billing page, which shows the effective end date; Paddle confirms it by e-mail.

Updates

During your subscription we provide the updates needed to keep Cullit compliant with its description, including security updates. The app offers updates and installs them with your consent, or automatically where you enable it. We may add, change or retire features, provided this does not deprive the service of its substance.

Legal warranty of conformity (consumers)

If you subscribe as a consumer in France or the EU, you benefit from the legal warranty of conformity for digital content and services (articles L224-25-12 and following of the French Consumer Code). For a service supplied continuously, Cullit must remain in conformity throughout the subscription; a lack of conformity that appears during that period is presumed to have existed, unless we prove otherwise. You may require that the service be brought into conformity free of charge and without undue delay; failing that, you may obtain a price reduction or terminate the contract. These rights apply in addition to any other remedy and cannot be waived.

Your photos and content

Your photos are yours. Cullit processes them on your computer; we never receive or store them (see the Privacy Policy). You keep all rights to your work.

Acceptable use

Do not use Cullit unlawfully, do not try to break, resell or reverse-engineer it, and do not misuse the referral programme.

Our intellectual property

Cullit, its name and its software are owned by Brice Virassamy. Your subscription grants you a personal, non-transferable licence to use the app while it is active.

Beta and warranties

Cullit is provided "as is" during the beta. We do not guarantee it will be uninterrupted or error-free, and it is not a substitute for your own backups. Nothing here limits the rights you have as a consumer under mandatory law.

Limitation of liability

To the extent permitted by law, our liability for any claim relating to Cullit is limited to the amount you paid in the 12 months before it arose, and we are not liable for indirect or consequential loss, including lost photos where backups were not kept.

Suspension and end of the service

We may suspend or terminate access in the event of a serious or repeated breach of these terms (fraud, abuse of the trial or of the referral programme, unlawful use), where possible after notice inviting you to remedy it. When your subscription ends, access to Pro features stops; your photos live on your own computer and never depend on us; you can have your account data deleted as described in the Privacy Policy.

Changes

We may update the app and these terms. We will revise the date above and, for significant changes, tell you in advance. Continuing to use Cullit means you accept the updated terms.

Governing law

These terms are governed by French law, without prejudice to any mandatory consumer-protection rules of your country of residence.

Business customers (B2B)

If you purchase for the purposes of your trade or profession: the consumer withdrawal right and the consumer legal warranty of conformity do not apply, save for mandatory exceptions (such as article L221-3 of the French Consumer Code for certain small businesses); enter your VAT number at checkout so Paddle applies the correct tax treatment; our liability is limited as set out above and indirect or consequential damages are excluded to the fullest extent permitted; and any dispute falls to the courts of the place of our registered office, subject to mandatory rules.

Users in the United States

For customers in the United States: the checkout and your account provide the automatic-renewal disclosures and the simple online cancellation required by applicable state laws, including California's Automatic Renewal Law — the price, the renewal term and how to cancel are presented before you pay, and you can cancel online at any time from your account's Billing page. Nothing in these terms waives rights that your state's law does not allow to be waived.

Support: support@cullit.app. If something goes wrong, contact us first — we do our best to resolve complaints quickly.
